Traditionally, Realtors® have represented only Sellers in a real estate transaction. (Did you know that?!?) During the 1980s, states across the country directed that agents must disclose to the Buyers that they legally represent Sellers. Buyers began asking, "Who represents me?" The result was the birth of a new service within the real estate industry called Buyer Advocacy or Buyer Agency. 
 

It can be complicated, but think of it this way - The seller has a written contract protecting himself/herself in the sale of their home; it is part of his/her marketing or listing agreement. As a buyer, you need and deserve the same protection. If you don't have a written contract securing your rights with an agent, you are merely a "customer" of the agent you are working with. Once you sign a formal Buyer's Representation Agreement you become a "Client" to that agent. As a Client that agent now has many legal responsibilties to you. In short they include:
  • Maintaining the buyer's confidentiality as to motives and price
  • Promising to never enter into a conflict of interest
  • Alway place the clients interests above all else
  • Disclose all adverse facts to which the agent has actual knowledge
  • Exercise reasonble care in providing service
  • Provide services in honesty and good faith
  • Obey all lawful instructions
  • Be loyal to clients intetests
  • Convey timely and accurate market conditions that may affect negotiations
  • Schedule all showings
  • Receive and negotiate all offers or counter-offers
  • Answer all questions within the scope the agent's expertise
  • Advise as to procedures and steps needed to advnace to a successful closing

You decide! 

Armed with this information, you are free to drive by the listed properties and through the neighborhoods to see if they meet your needs. This is hassle-free shopping at its best with no salesperson pressuring you.
